General privacy policy

Garo&Friends recognizes the importance of protecting the privacy of your personal data. We have instituted strict policies and security measures to protect the information you provide us. Most of our processing of your personal data is necessary for us to perform our contractual obligations to you, and other kinds of processing relies on Grbo&Friends’ legitimate interest for processing as set out below. If you have subscribed for membership with Garbo&Friends, some of the processing is based on your consent, as set out below.

The Swedish company Garbo&Friends AB reg. no. 556872-1319 (“Garbo&Friends”), is the controller of your personal data. Garbo&Friends’ affiliated companies (including joint ventures, franchisees and licensees) and selected suppliers may process your personal data on Garbo&Friends’ behalf and in accordance with Garbo&Friends’ instructions as stated below, and are thereby processors of your personal data.

3.1 General

Below is a summary of the categories of data that we process, the purposes of processing the data and on what legal basis we are processing your data. Please see section 8 below for information on how long we keep your data. Our processing of your personal data depends on whether you have subscribed for membership with us or not. The processing of personal data relating to customers that are not members, is described in section 3.2 below. The processing of our members’ personal data is described in section 3.3 below.

How does Garbo&Friends use the information you provide?

If you give us your personal information, then with your consent, Garbo&Friends will use this information to keep you informed of our special events or promotions, to register you with our website, to administer our website services, and/or to process any orders you may place online. Otherwise, we may use the information you provide to us only to review our performance and to improve our services to you, or to communicate with you about your order if you have placed an online order. We will send you announcements or communications by email only if you give us your permission to do so. In addition, we may use information about your product interests and purchases from us and our affiliates, including without limitation Garbo&Friends AB, to help us improve our site design and your online and in- store shopping experiences. We may contact you, subject to the choices you have made, via e-mail, postal mail, or telephone, to conduct market research and learn more about how we can improve our product offerings. To serve you better, we may combine information you give us and information about your product interest and purchases with information from third parties, including demographic information and information that is publicly available. We may also combine this information with information from our affiliates. We use that combined information to enhance and personalize your shopping experience with us, and to communicate with you in accordance with this policy.

3.2 Customers (non-members)

Contact details: If you make a purchase online we will collect your name, address, email address, telephone number, country of residence, date of birth, title (Ms./Mr. or other title) and social media account contact details. Not all information is mandatory for making a purchase. We have marked mandatory information with the symbol (*) on our website. We will use your contact information to (i) process your purchase/orders and any returns, exchanges and complaints you may have relating to your purchase; and to (ii) communicate with you regarding your purchase and to answer and administer any questions or comments you may have regarding our products or services. This processing is necessary in order for us to be able to fulfill our contractual obligations to you. If you have subscribed to one of our newsletters, we will also use your contact details to send out such newsletter, based on your consent. We may also process your contact details that you have shared with us when you have purchased a product, to keep you informed, via email or other messenger services, of our special events or promotions. This processing is based our legitimate interest of being able to market our products to our existing customers.

Credit card details: If you make a purchase online and chose to pay by credit card, you will provide your credit card information on our partner PayEx website to finalize your purchase. Your credit card details will be protected using PayEx Secure Encryption The processing of your credit card details is necessary in order for us to be able to fulfill our contractual obligations to you.

Previous purchases and returns: If you have signed up for an account, we will store information regarding (i) your purchases and returns online, and (ii) your purchases and returns in physical stores, if you have provided your email address to our personnel. Such information encompasses product, size, price and date of purchase. This will allow you to keep track of your purchases and returns by logging into your personal account.

ID number: If you chose to make your payment by invoice, you may be required to provide your personal ID number on our website. Your ID number will be directly transferred and available only to our payment service provider, which will process your ID number to be able to obtain a credit report and to facilitate your payment.

Anonymized data: We may also use anonymized data for our internal marketing and demographic studies to analyze, profile and monitor customer patterns in order for us to be able to improve our products and services.

3.3 Members

Contact details: If you sign up for a membership with Garbo&Friends, for instance when making a purchase online, we will collect your name, address, email address, telephone number, country of residence, date of birth, title (Ms./Mr. or other title) and social media account contact details. Not all information is mandatory for making a purchase. We have marked mandatory information with the symbol (*) on our website. We will use your contact information to (i) process your purchase/orders and any returns, exchanges and complaints you may have relating to your purchase; (ii) communicate with you regarding your purchase and to answer and administer any questions or comments you may have regarding our products or services, and (iii) if you sign up for a membership with Garbo&Friends; to create your personal account and process your membership. This processing is necessary in order for us to be able to fulfill our contractual obligations to you. We may also use your contact details to fulfill our services you subscribed to in accordance with the Membership Policy, including sending out invitations to special events/promotions, personalized services and profiled marketing offers through email or other messenger services. This processing is based on your consent. If you have subscribed to one of our newsletters, we will also use your contact details to send out such newsletter, based on your consent.

3.4 Consent and withdrawal

By accepting this privacy policy, you have confirmed that you have read and understood the content of this privacy policy, and that you, as applicable, consent to Garbo&Friends’ processing of your personal data in accordance with the provisions herein. Should you wish to object to, or withdraw your consent, to any of our processing, please contact us at customer@garboandfriends.com. Please note however that your withdrawal will not affect our right to process your data when such processing is necessary to perform our contractual obligations to you, and/or to the extent we are required to process your data by law or to defend ourselves in a dispute, to prevent fraud or abuse, or to enforce our Terms and Conditions. If you withdraw your consent to any consent-based processing, we will cease all such processing.

Protecting your information

Garbo&Friends does not sell or rent our customer’s personal data to any other entity.
We may share your data with affiliated companies including other companies within the Garbo&Friends group, joint ventures, franchisees and licensees. If you have subscribed for membership with Garbo&Friends, we may combine your data provided to us with data that you have provided to such affiliated companies, for the purpose of improving our services to you, and to enhance your shopping experience. This processing is based on your consent.

Garbo&Friends may also share our customers’ data with selected suppliers who perform functions on our behalf such as fulfilling orders and delivery of orders, processing payments, carrying out promotional services or data management, to maintain our website, to distribute emails, to send out our newsletter, to provide client communications and to manage our customer database. As necessary, the personal data you provide to us may be processed by these third parties, solely on Garbo&Friends behalf and in accordance with Garbo&Friends’ instructions as data processors. We do not authorize any of our suppliers to make any other use of your personal data.

If Garbo&Friends is acquired by another entity or is merged or consolidated, information about Garbo&Friends customers may be made available to the new entity. However, Garbo&Friends will ensure that the new entity will agree to protect the confidentiality of your personal information consistent with this privacy policy.

5. Transfer outside of the EU/EES

If you have subscribed to membership with Garbo&Friends, we will share your contact details and information on previous purchases and shopping preferences with our affiliated companies both inside and outside of the EU/EES (please see further under section 4). We may also share your data with our selected suppliers, who may process your data in countries both inside and outside of the EU/EES when performing functions on our behalf as set out in section 4 above.

6. Where do we store your data?

The data that we collect from you is stored within the European Economic Area (“EEA”) but may also be transferred to and processed in a country outside of the EEA. Any such transfer of your personal data will be carried out in compliance with applicable laws. For transfers outside the EEA, Garbo&Friends will use Standard Contractual Clauses and Privacy Shield as safeguards for countries without adequacy decision from the European Commission.

7. Your data subject rights

In this section 6, we have summarized your data subject rights to request access, rectification, erasure of your personal data, to restrict the processing of your personal data, to object to processing, and your right to lodge a complaint with the supervisory authority.

If you have signed up for a membership with Garbo&Friends you will also be able to access, rectify and erase some of your data by logging in to your private account.
Notwithstanding anything to the contrary herein, Garbo&Friends reserves the right to keep and process your personal data in accordance with this policy to the extent necessary to perform our contractual obligations to you, and to the extent we are required to process your data by law or in order to defend ourselves in a dispute, to prevent fraud or abuse, or to enforce our Terms and Conditions.

7.1 Right to access

You have the right to request information about the personal data we hold on you at any time. You can contact Garbo&Friends that will provide you with your personal data via e-mail.

7.2 Right to portability

Whenever Garbo&Friends process your personal data by automated means based on your consent or based on an agreement you have the right to get a copy of your data transferred to you or to another party. This only includes the personal data you have submitted to us.

7.3 Right to rectification

You have the right to request rectification of your personal data if they are incorrect, including the right to have incomplete personal data completed. If you have a Garbo&Friends account you can edit your personal data under your account and membership pages.

7.4 Right to erasure

You have the right to erase any personal data processed by Garbo&Friends at any time except for the following situations
– you have an ongoing matter with Customer Service
– you have an open order which has not yet been shipped or partially shipped
– you have an unsettled debt with Garbo&Friends, regardless of the payment method
– if you are suspected or have misused our services within the last four years
– if you have made any purchase, we will keep your personal data in connection to your transaction for bookkeeping rules.

7.5 Your right to object to processing based on legitimate interest

You have the right to object to processing of your personal data that is based on Garbo&Friends legitimate interest. Garbo&Friends will not continue to process the personal data unless we can demonstrate a legitimate ground for the process which overrides your interest and rights or due to legal claims.

7.6 Your right to object to direct marketing

You have the right to object to direct marketing, including profiling analysis made for direct marketing purposes.

You can opt out from direct marketing by the following means:
– following the instruction in each marketing mails
– by editing the settings of your Garbo&Friends account

7.7 Right to restriction

You have the right to request that Garbo&Friends restricts the process of your personal data under the following circumstances:
– if you object to a processing based Garbo&Friends legitimate interest, Garbo&Friends shall restrict all processing of such data pending the verification of the legitimate interest.
– if you have claim that your personal data is incorrect, Garbo&Friends must restrict all processing of such data pending the verification of the accuracy of the personal data.
– if the processing is unlawful you can oppose the erasure of personal data and instead request the restriction of the use of your personal data instead
– if Garbo&Friends no longer needs the personal data but it is required for your to make of defending legal claims.

7.8 Data Protection Officer

We have appointed a Data Protection Officer to ensure that we continuously process your personal data in an open, accurate and legal manner. You can contact our Data Protection Officer at customer@garboandfriends.com and write DPO as subject matter.

7.9 Right to lodge a complaint with supervisory authority

Please note that if you consider the processing of your data to be in violation of applicable data protection laws, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence or the place of the alleged infringement.

8. How do I unsubscribe from Garbo&Friends newsletters and emails?

If you do no longer wish to receive our newsletters or other emails, you can unsubscribe as indicated in the particular communication, i.e. by using the unsubscribe link which is included on all newsletters and other emails. You may also contact us at customer@garboandfriends.com

9. How long do we keep your data?

We will retain your personal information for as long as necessary in relation to the purposes for which they were collected or otherwise processed. If you have not signed up for membership with Garbo&Friends and we received your contact details as part of your purchase online, we may use your contact details for direct marketing purposes for up to 12 months after your latest purchase subject to your ongoing right to opt-out. Thereafter we will delete your data unless we need to keep it for other purposes that are legally justifiable. If you have signed up for a membership with Garbo&Friends we will save your data for as long as your membership is active or as needed to provide you with our services. We will also retain your personal information as necessary to comply with applicable legal obligations, to resolve disputes, and to enforce our agreements.

10. Is it mandatory to provide personal data?

When you purchase our products online, or sign up for a membership with Garbo&Friends, we will inform you which data is mandatory by marking certain fields with a symbol (*). The provision of mandatory data is necessary for Garbo&Friends to be able to fulfill our contractual obligation to you, for example processing your order, or fulfilling the membership services requested by you. For every specific processing of personal data we collect from you we will inform you whether the provision of personal data is statutory or required to enter a contract and whether it is an obligation to provide the personal data and possible consequences if you choose not to.

11. Children's privacy and legal purchase age

Garbo&Friends does not wish to collect personal information from anyone under the age of sixteen (16). If you are under eighteen (18), we require that you inform and get your parents or guardians consent before purchasing anything or provide any personal data to us at garboanfriends.com

13. Privacy Notice Direct Marketing

1. Why do we use your personal data?
We will use your personal data to send you marketing offers, information surveys and invitations through e-mails, text messages, phone calls and postal mail.

In order to optimize your experience of Garbo&Friends we will provide you with relevant information, recommend products, send you reminders of products left in your shopping bag and send you personalized offers. All these great services are based on your previous purchases, what you have clicked on and information you have submitted to us.

2. What types of personal data do we process?
We will process following categories of personal data
– contact information such as e-mail address, telephone number and postal code
–  gender (if you choose to provide that to us)
–  what products and offers you have clicked on

If you have a Garbo&Friends account we will also process your personal data submitted in relation to the account and membership such as
–  name
–  address
–  age
–  shopping history
–  how you navigated and clicked on the site

3. Who has access to your personal data?
Data that is forwarded to third parties is only used to provide you with the service mentioned above, to media agencies and technical suppliers for distribution of physical and digital direct marketing. We never pass on, sell or swap your data for marketing purposes to third parties outside Garbo&Friends.

4. What is the legal ground to process your personal data?
The processing of your personal data is based on your consent when you agree to direct marketing. Except for postal marketing, including catalogues, that will be sent to you based on our legitimate interest.

5. Your right to withdraw your consent.
You have the right to withdraw your consent for the processing of your personal data at any time and object to direct marketing. When you do so Garbo&Friends won’t be able to send you any further direct marketing offers or information based on your consent.

– by editing the settings of your Garbo&Friends account

6. How long do we save your data?
We will keep your data for direct marketing until you withdraw your consent. For e-mail marketing we will consider you an inactive customer if you haven’t opened an e-mail for within the last year. After this time period your personal data will be deleted.

14. Modifications

Garbo&Friends reserves the right to occasionally make changes to our privacy policy or practices. We will post the updated policy on our website, and thus we encourage you to review this page from time to time.
